Permeable Driveways and Drainage Rules in Leicester
The most useful question to ask about a new driveway is simple: where will rainwater go when it lands on it? A front garden may be small, but replacing soil or planting with a sealed surface can send water towards a doorway, neighbour or pavement. Surface choice, foundations and finished levels need to work together.
What makes a driveway permeable?
A genuinely permeable driveway lets rainwater move through the entire designed construction, with the base and ground below able to receive, hold or safely manage it. Government guidance names gravel, permeable concrete block paving and porous asphalt as possible surfaces. Resin bound aggregate can also allow water through, but the surface alone is not enough: a sealed base below it can stop infiltration. A conventional block paved surface and a resin bonded surface should not be assumed permeable.
The government also allows an alternative route: an impermeable surface can be laid so that water runs to a lawn or border and drains naturally within the property. The detailed solution still needs to suit the site. Official permeable surfacing guidance.
Why does the 5 m² rule matter?
Under the general front garden rule in England, an impermeable new or replacement hard surface over 5 m² requires planning permission if it makes no provision to direct water to a permeable area. A suitable permeable system or properly directed runoff can avoid that particular trigger, subject to restrictions applying to the property. Which drainage approach might work?
Permeable construction: Rain passes through the surface and suitable layers beneath it. An installer needs to check the ground, available depth and how the system will behave in heavy rain. A decorative top layer does not establish suitability on its own.
Falls towards planting: A correctly graded impermeable drive can discharge to a lawn or border within the property, where the area and soil can take the flow. A token strip of soil is not automatically adequate for a large drive.
Collection and disposal: A channel may intercept water near a threshold or boundary, but its outlet matters. The installer should explain the destination and whether any additional consents or a designed soakaway are required. Water should not simply be redirected onto the highway or a neighbouring plot.
The right option depends on existing levels, ground conditions, available space and the surface the homeowner wants. If the old drive ponds in one place, identify the cause before selecting a new top layer.
How does the material affect the design?
Permeable block paving uses a specified system, including appropriate joints and supporting layers; it is distinct from ordinary blocks laid conventionally. Resin bound driveways can form part of a permeable build when the base is designed for it. Standard tarmac is normally impermeable and generally needs appropriate falls and a suitable runoff destination; porous asphalt is a different specification.
